Terms of Use: Messaging Platform

These terms apply to the use of the SKYLNX messaging platform. The platform is intended for businesses that have entered into an agreement with SKYLNX (businesses) and their staff. Customers of a business who write to it via WhatsApp do not use the platform themselves and do not enter into a contract with SKYLNX.

The platform receives a business's messages via WhatsApp, email and phone, analyses them with AI support, prepares orders and requests for review, and supports delivery planning. The connection to WhatsApp uses the WhatsApp Business Platform of Meta.

• The business uses the platform only for its own business communication with its customers.
• The business complies with the terms of WhatsApp and Meta and with applicable law. This includes sending messages only to persons for whom a legal basis exists.
• The business keeps its access credentials secure and does not share them with unauthorised persons.
• The business reviews orders and requests before they are executed. Approval rests with the business.

SKYLNX strives for high availability of the platform. No specific availability is guaranteed. Maintenance work as well as disruptions at WhatsApp, Meta or other third-party providers are outside SKYLNX's control. The platform is designed so that the business can continue to use WhatsApp in its WhatsApp Business app.

The processing of personal data is described in the privacy notice for the messaging platform (/en/privacy-policy-platform). SKYLNX processes data on behalf of the business under a data processing agreement pursuant to Art. 28 GDPR.

SKYLNX is liable without limitation for intent and gross negligence, for injury to life, body and health, and under the Product Liability Act. In cases of slight negligence, SKYLNX is liable only for breach of essential contractual obligations and limited to the foreseeable damage typical for this type of contract. Liability for content and outages of WhatsApp and Meta is excluded to the extent permitted by law.

Use is governed by the agreement between SKYLNX and the business. After termination, the business's data is deleted in line with the periods stated in the privacy notice or handed over to the business on request.

SKYLNX may change these terms with effect for the future. The current version is available on this page.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Berlin where the business is a merchant.
